After an announced / unannounced visit at the Tier 2 sponsor’s premises, the UKVI may raise various concerns in relation to genuine vacancy requirements, sponsor’s general duties, migrant tracking & reporting duties and record keeping & recruitment practices. There have also been allegations of various IT companies acting as an employment agency or as a business that is merely supplying labour.

Real Case Study

The Challenge

One of our clients – an IT company – was recently visited by the UKVI as the majority of their work force consists of sponsored migrant workers. The Home Office suspended their licence, stating in the suspension letter that the UKVI failed to understand how the company was checking employees’ right to work to comply with their duties as a licensed sponsor and contribute to effective immigration control to prevent illegal working.

The UKVI was simply not satisfied that the positions offered to sponsored workers represented genuine vacancies. They alleged that the company had failed to update its licence across all branches their sponsored workers were required to work in, and that there was no evidence of an adequate system to update and maintain historical contact details for the sponsored workers.

At a separate instance, it was alleged that the sponsor failed to meet their reporting duties and that they were supplying workers to third party organisations who then contracted them out to their own clients.
