Word of caution to sponsors licensed under Tier 2 & Tier 5
I want to share a recent experience of one of my client. This company is a sponsor licensed under Tier 2 and they had an unannounced Home office compliance visit.
A very strong allegation
It is alleged by my client that the interview notes which the Home office’s compliance officer asked them to sign were altered afterwards. The company chose to instruct a forensic examination of the document. An Independent forensic expert has raised the concern about the “interview notes” and has requested the original interview notes to provide a conclusion as to whether the “interview notes” were tampered by the compliance officer after the compliance visit or not.
Learning lesson from this experience
Nothing has been concluded yet but word of caution to Tier 2 sponsors to keep it simple. From this latest experience I would like to share certain points that one must keep in mind when they get a visit from the Home Office compliance team.
1) Please take your own time and always read carefully the “interview notes” and/or any paper you sign.
2) Always ask for copy of the “interview notes” and/or any paper you sign there and then.
3) If you do not have a photocopier available you may want to use your smart phone to take readable picture of the document you are signing.
